01 Introduction

This Privacy Policy explains how Promofy ("Promofy", "we", "our", or "us") collects, uses, stores, shares, and protects information when you access or use the Promofy mobile application, website, and related services (collectively, the "Platform").

Promofy is a technology-enabled marketing marketplace that helps Businesses, Brands, Influencers, Content Creators, Digital Marketing Agencies, and Hoarding Vendors discover each other, connect, and initiate marketing collaborations through a single platform.

This Privacy Policy applies to all visitors, registered users, Buyers, Sellers, agencies, businesses, creators, vendors, and any other person accessing or using the Platform.

By accessing or using the Platform, you acknowledge that you have read and understood this Privacy Policy and consent to the collection, use, storage, disclosure, and processing of your information as described herein, subject to applicable laws. If you do not agree with this Privacy Policy, you should discontinue using the Platform.

This Privacy Policy should be read together with our User Agreement & Terms of Service. Where both documents apply, they shall be interpreted together to govern your use of the Platform.

We are committed to handling personal information responsibly and implementing reasonable administrative, technical, and organizational safeguards to help protect your information. However, no method of electronic transmission, storage, or internet communication can be guaranteed to be completely secure.

Depending on how you use Promofy, the information we collect and the way it is used may differ between Business Users, Sellers, and general visitors. The following sections explain what information we collect, why we collect it, how it is used, how it may be shared, and the choices available to you regarding your information.

02 Information We Collect

We collect information that you voluntarily provide, information generated through your use of the Platform, and certain technical information required to operate, maintain, improve, and secure Promofy.

Depending on how you use the Platform, we may collect the following categories of information:

  • Personal Information, such as your name, mobile number, email address, profile photograph, and other information you choose to provide while creating or managing your account.
  • Business Information, including business name, business type, city, address, GST information (where applicable), and other business-related details submitted through the Platform.
  • Seller Information, including profile details, services, categories, pricing, descriptions, portfolio images, social media profile links, audience information, languages, locations, and other listing-related information.
  • Enquiry Information, including campaign requirements, marketing preferences, budgets, locations, communication details, and other information submitted while sending enquiries through the Platform.
  • Content You Upload, including images, portfolio samples, documents, profile photographs, business logos, and other files voluntarily uploaded by you.
  • Device & Technical Information, such as device model, operating system, app version, language, IP address, browser type, crash logs, approximate location derived from IP (where applicable), and other technical information necessary for security, diagnostics, and Platform performance.
  • Usage Information, including how you interact with the Platform, features used, pages viewed, searches performed, enquiries submitted, clicks, session activity, and other usage analytics that help improve our services.

Certain information is mandatory to create an account or access specific Platform features. If required information is not provided, some services or functionality may not be available.

We do not intentionally collect personal information beyond what is reasonably necessary to provide, operate, improve, secure, and support the Platform in accordance with this Privacy Policy and applicable laws.

03 Account & Profile Information

To access certain features of Promofy, users may be required to create an account. During registration and while using the Platform, we collect and maintain the information necessary to identify users, provide Platform services, and support account management.

Depending on your role and the features you use, your account information may include your name, mobile number, email address, profile photograph, city, business information, account type, verification status, login details, and other information voluntarily provided by you.

We use this information to:

  • Create and manage your account.
  • Authenticate your identity and secure your account.
  • Provide access to Platform features.
  • Communicate important account, security, and service-related updates.
  • Respond to support requests and resolve technical issues.
  • Maintain the integrity, security, and proper functioning of the Platform.

Certain account information, such as your display name, profile photograph, business name, city, verification status (where applicable), and other profile details that you choose to publish, may be visible to other users of the Platform as part of your public profile or listing.

You are responsible for ensuring that your account information remains accurate, complete, and up to date. You may update eligible profile information through your account settings or by contacting Promofy where applicable.

We use reasonable measures to help protect account information from unauthorized access. However, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

Promofy may request additional information or verification where reasonably necessary to verify account ownership, investigate suspected misuse, comply with legal obligations, or improve Platform security.

04 Seller Information

If you register as an Influencer, Content Creator, Digital Marketing Agency, Hoarding Vendor, or any other Seller on Promofy, we collect additional information required to create, manage, and display your Seller profile and listings on the Platform.

Depending on your Seller category, this information may include your profile photograph or logo, business or creator name, city, service categories, descriptions, pricing, languages, audience information, social media profile links, portfolio images, sample work, availability, contact details, and other information voluntarily submitted by you.

We use this information to:

  • Create and manage your Seller profile and listings.
  • Display your services to Businesses and Brands using the Platform.
  • Enable Buyers to discover, compare, and submit enquiries.
  • Review listings for quality, safety, and compliance with Platform policies.
  • Provide Platform support and improve search, categorization, and user experience.

Certain Seller profile information is intended to be publicly visible to Platform users for discovery purposes. Public information may include your display name, profile photograph or logo, city, services, categories, pricing (where applicable), portfolio samples, profile description, social media links, verification status (where applicable), and other information that forms part of your published listing.

Seller profiles and listings may be reviewed before publication and may be edited, categorized, formatted, or moderated by Promofy to improve consistency, readability, searchability, security, and overall Platform experience. Such moderation does not imply endorsement or verification of the Seller or the information provided.

Sellers remain responsible for ensuring that all information published through their account is accurate, lawful, and kept reasonably up to date. Sellers may update eligible profile information through the Platform after approval or by contacting Promofy where applicable.

05 Business Enquiry Information

When Businesses, Brands, or other users submit enquiries through Promofy, we collect the information necessary to facilitate communication and help connect Buyers with relevant Sellers on the Platform.

Depending on the enquiry, this information may include your name, business name, contact details, city, campaign requirements, marketing objectives, preferred services, budget range, target audience, preferred timeline, locations, and any additional information or attachments voluntarily provided by you.

We use enquiry information to:

  • Process and manage your enquiry.
  • Connect your enquiry with relevant Sellers.
  • Facilitate communication between Buyers and Sellers.
  • Provide customer support and respond to your requests.
  • Improve Platform services, search relevance, and user experience.
  • Maintain Platform security and investigate misuse or fraudulent activity where necessary.

Information submitted through an enquiry may be shared with the relevant Seller or the Seller's authorized representative to the extent reasonably necessary for reviewing the enquiry, discussing project requirements, preparing quotations, and determining whether to proceed with a potential collaboration.

Once a Buyer and Seller choose to continue discussions or enter into a commercial relationship, further communications, negotiations, agreements, payments, deliverables, and project execution occur directly between the respective parties, unless Promofy expressly provides additional facilitation services.

Users should avoid including unnecessary sensitive personal information in enquiry messages unless it is reasonably required for the requested marketing service.

06 Uploaded Images & Portfolio Content

Promofy allows users to upload images, logos, portfolio samples, project showcases, creative work, profile photographs, business branding materials, and other visual content ("Portfolio Content") to enhance their profiles, listings, and overall Platform experience.

You retain ownership of the content you upload. However, by uploading or publishing Portfolio Content on the Platform, you grant Promofy a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, resize, optimize, format, and use such content solely for the purpose of operating, maintaining, improving, securing, promoting, and displaying the Platform and its related services.

You represent and warrant that you own, control, or otherwise have all necessary rights, permissions, licenses, and legal authority to upload and publish the Portfolio Content, and that doing so does not infringe any copyright, trademark, privacy, publicity, contractual, or other legal rights of any third party.

Portfolio Content may be displayed publicly as part of your profile or listing to help other users understand your services, experience, or previous work. Promofy may resize, compress, optimize, crop, or format uploaded content where reasonably necessary to improve Platform performance, consistency, security, compatibility, or user experience, without materially altering its intended meaning.

Users remain solely responsible for the legality, accuracy, quality, and appropriateness of the content they upload. Promofy does not independently verify the ownership, authenticity, originality, or accuracy of Portfolio Content submitted by users.

Promofy reserves the right to review, moderate, temporarily restrict, or remove Portfolio Content that reasonably appears to violate applicable laws, these Privacy Policy provisions, our Terms of Service, intellectual property rights, Platform policies, or that may create legal, security, operational, or reputational risks for the Platform or its users.

07 How Information Is Used

Promofy uses the information we collect to operate, maintain, improve, secure, and provide the Platform and its related services. We process personal and business information only for legitimate business purposes and in accordance with this Privacy Policy and applicable laws.

Depending on how you use the Platform, we may use your information to:

  • Create, verify, manage, and maintain your account and profile.
  • Display and manage business, creator, agency, or hoarding listings on the Platform.
  • Enable Businesses and Sellers to discover one another and submit or receive enquiries.
  • Facilitate communication and collaboration opportunities between Platform users.
  • Review, moderate, organize, categorize, and improve listings, profile information, and Platform content.
  • Respond to enquiries, customer support requests, technical issues, and account-related communications.
  • Provide important notifications regarding your account, Platform updates, security alerts, verification status, or policy changes.
  • Improve Platform functionality, search relevance, recommendations, user experience, accessibility, and overall service quality.
  • Analyze usage trends, diagnose technical issues, monitor Platform performance, detect bugs, and enhance reliability.
  • Protect the Platform, its users, and our business from fraud, abuse, unauthorized access, security threats, spam, and other unlawful activities.
  • Comply with applicable legal obligations, regulatory requirements, court orders, or lawful requests from competent authorities.
  • Develop new features, services, categories, verification programs, subscription plans, payment services, analytics, and other Platform improvements.

We may use aggregated or de-identified information that does not reasonably identify any individual user for analytics, reporting, research, service improvement, business planning, and statistical purposes.

We do not sell your personal information to third parties for their independent marketing purposes.

08 How Information May Be Shared

Promofy respects your privacy and does not sell your personal information to third parties for their independent marketing purposes. We may share information only where reasonably necessary to operate the Platform, provide requested services, comply with legal obligations, protect legitimate interests, or as otherwise described in this Privacy Policy.

Depending on the nature of the Platform service, information may be shared in the following circumstances:

  • With Other Platform Users: Certain profile and listing information is intentionally displayed to facilitate discovery and business enquiries between Buyers and Sellers.
  • For Business Enquiries: Information submitted through an enquiry may be shared with the relevant Seller or the Seller's authorized representative to enable review of the enquiry, communication, quotations, and potential collaboration.
  • With Service Providers: We may share information with trusted third-party service providers that assist us with hosting, cloud infrastructure, analytics, authentication, notifications, payment processing, customer support, security, technical operations, or other services necessary to operate the Platform. Such providers are permitted to process information only for the services they perform on our behalf.
  • Legal & Regulatory Requirements: We may disclose information where required to comply with applicable laws, regulations, court orders, legal processes, or lawful requests from competent governmental or regulatory authorities.
  • Protection of Rights: We may disclose information where reasonably necessary to investigate fraud, unauthorized activities, security incidents, suspected violations of our Terms or policies, or to protect the rights, safety, property, or legitimate interests of Promofy, our users, or others.
  • Business Transfers: If Promofy undergoes a merger, acquisition, investment, restructuring, sale of assets, or similar business transaction, user information may be transferred as part of that transaction, subject to applicable legal requirements.

We may also share aggregated, anonymized, or de-identified information that cannot reasonably identify an individual user for analytics, reporting, research, business planning, or service improvement purposes.

Except as described in this Privacy Policy or where required by applicable law, Promofy does not disclose your personal information to third parties without an appropriate legal basis.

09 Service Providers / Third-Party Services

Promofy relies on trusted third-party service providers to help operate, maintain, secure, and improve the Platform. These providers perform services on our behalf and may process information only to the extent reasonably necessary to provide those services, subject to their contractual obligations and applicable laws.

Depending on the features you use, we may engage third-party providers for services including:

  • Cloud hosting, infrastructure, database management, and content delivery.
  • User authentication, account verification, OTP delivery, login services, and security.
  • Analytics, crash reporting, diagnostics, and Platform performance monitoring.
  • Push notifications, email delivery, SMS, customer communication, and technical support.
  • Payment gateways, banking partners, subscription processing, and financial transaction services (where applicable).
  • Image storage, media optimization, file management, and related technical services.
  • Fraud prevention, cybersecurity, monitoring, and Platform protection.

These service providers may process information on our behalf only for the purposes of providing the services requested by Promofy. They are not authorized to use your personal information for their own independent marketing purposes based solely on their relationship with Promofy.

Certain third-party services integrated into the Platform may have their own Privacy Policies and Terms of Service. Your use of those services is governed by the respective third-party policies in addition to this Privacy Policy. We encourage users to review the privacy practices of such third-party providers where appropriate.

While Promofy makes reasonable efforts to work with reputable service providers, we do not own or control their independent systems, infrastructure, or privacy practices and cannot guarantee the security, availability, or performance of third-party services beyond our reasonable control.

10 App Permissions

Depending on the features you choose to use, Promofy may request access to certain device permissions. We request only those permissions that are reasonably necessary to provide specific Platform functionality. You may grant, deny, or revoke most permissions at any time through your device settings, although doing so may limit the availability of certain features.

Promofy may request the following permissions, where applicable:

  • Camera: To capture profile photographs, portfolio images, business logos, documents, or other content that you choose to upload.
  • Photos / Media / Storage: To allow you to select and upload profile pictures, portfolio images, logos, and other files from your device.
  • Notifications: To deliver important account updates, enquiry notifications, approval status, security alerts, and other service-related communications.
  • Internet & Network Access: Required for authentication, Platform functionality, content loading, enquiries, image uploads, synchronization, and communication with our servers.

Some mobile operating systems may automatically request additional technical permissions required for normal application operation. Such permissions are controlled by your device's operating system and applicable platform policies.

Promofy does not access your device camera, media, or other protected device resources unless you voluntarily initiate an action that requires the relevant permission or unless such access is reasonably necessary to provide the feature you have requested.

If future Platform features require additional permissions, Promofy will request those permissions in accordance with applicable operating system requirements and this Privacy Policy.

11 Data Security

Promofy is committed to protecting the information entrusted to us. We implement reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, misuse, or destruction, taking into account the nature of the information and the risks involved.

Security measures may include access controls, authentication mechanisms, encrypted communications where appropriate, secure cloud infrastructure, monitoring, backups, and other reasonable practices intended to support the confidentiality, integrity, and availability of Platform information.

Access to personal information is limited to authorized personnel, trusted service providers, and systems that require such access for legitimate business, operational, technical, security, or legal purposes.

While we make reasonable efforts to protect your information, no method of electronic transmission, internet communication, cloud storage, or electronic data storage can be guaranteed to be completely secure. Accordingly, Promofy cannot guarantee absolute security of any information transmitted to or stored through the Platform.

Users are also responsible for helping protect their own accounts by maintaining the confidentiality of their login credentials, using secure devices and networks, and promptly notifying Promofy if they become aware of any suspected unauthorized access, security incident, or misuse of their account.

If Promofy becomes aware of a security incident affecting personal information, we may take appropriate steps to investigate, mitigate, recover from the incident, and, where required by applicable law, notify affected users and competent authorities.

12 Data Retention

Promofy retains personal information only for as long as it is reasonably necessary to provide the Platform, fulfill the purposes described in this Privacy Policy, comply with applicable legal obligations, resolve disputes, enforce our Terms, protect the security of the Platform, and support legitimate business operations.

The length of time we retain information depends on several factors, including the type of information, the nature of your relationship with Promofy, applicable legal requirements, operational needs, security considerations, and whether the information is required for ongoing investigations or dispute resolution.

Even if you stop using the Platform or request account deletion, certain information may be retained where reasonably necessary to:

  • Comply with applicable laws, regulations, court orders, or lawful governmental requests.
  • Maintain financial, accounting, taxation, audit, or regulatory records where required.
  • Detect, investigate, prevent, or respond to fraud, abuse, security incidents, or unlawful activities.
  • Resolve disputes, enforce our Terms and policies, or protect the legal rights, safety, and legitimate interests of Promofy or other users.
  • Maintain backup, disaster recovery, archival, or business continuity systems for a reasonable period.

When personal information is no longer reasonably required for the purposes described above, Promofy will take reasonable steps to delete, anonymize, de-identify, or securely dispose of such information in accordance with applicable laws and operational requirements.

13 Account / Data Deletion Requests

We respect your right to request the deletion of your account and applicable personal information. You may request account deletion by using any account deletion feature made available within the Platform or by contacting Promofy through the official support channels provided on the Platform.

Upon receiving a valid deletion request, Promofy may take reasonable steps to verify your identity before processing the request in order to protect your account and prevent unauthorized deletion.

Once your deletion request has been verified and processed, your account will be deactivated or deleted, and your publicly visible profile or listing will no longer be available on the Platform, except where continued display is reasonably required by law or for legitimate operational purposes.

Please note that deleting your account does not necessarily result in the immediate deletion of all associated information. Certain information may be retained where reasonably necessary to:

  • Comply with applicable legal, regulatory, taxation, accounting, or audit obligations.
  • Resolve disputes or enforce our Terms, policies, or other legal rights.
  • Detect, investigate, prevent, or respond to fraud, abuse, security incidents, or unlawful activities.
  • Maintain backup, disaster recovery, archival, or business continuity systems for a reasonable period.

Where personal information is no longer required for these legitimate purposes, Promofy will take reasonable steps to securely delete, anonymize, or de-identify such information in accordance with applicable laws and operational requirements.

14 Children's Privacy

Promofy is intended for use by Businesses, Brands, Influencers, Content Creators, Digital Marketing Agencies, Hoarding Vendors, and other users who are legally capable of entering into binding agreements under applicable law. The Platform is not directed toward children.

We do not knowingly collect personal information from individuals who are below the minimum age permitted to use the Platform under applicable law without appropriate authorization where legally required.

If we become aware that personal information has been collected from a child in violation of applicable law or this Privacy Policy, we will take reasonable steps to investigate the matter and, where appropriate, delete or restrict access to such information within a reasonable period, unless retention is required by law.

If you believe that a child has provided personal information through the Platform in a manner that may be inconsistent with this Privacy Policy, please contact Promofy using the official contact details provided below so that we can review the matter and take appropriate action.

15 Changes to This Privacy Policy

Promofy may update, revise, modify, or replace this Privacy Policy from time to time to reflect changes in our Platform, services, technology, business operations, legal requirements, security practices, or other legitimate operational needs.

Where reasonably practicable, we may notify users of material changes through the Platform, website, mobile application, email, or other appropriate communication channels. However, users are responsible for periodically reviewing the most current version of this Privacy Policy.

The updated Privacy Policy will become effective from the "Last Updated" date displayed on this page, unless otherwise stated.

Your continued access to or use of the Platform after the revised Privacy Policy becomes effective constitutes your acknowledgment of the updated Privacy Policy. If you do not agree with the revised Privacy Policy, you should discontinue using the Platform and may request account deletion in accordance with this Privacy Policy.

If any provision of this Privacy Policy is found to be invalid or unenforceable under applicable law, the remaining provisions shall continue to remain in full force and effect to the maximum extent permitted by law.
